Iowa (IA) Mesothelioma Attorneys and Asbestos Cancer Resources (IA)


Iowa (IA) Asbestos Information:

Iowa's primary industry is agriculture; as a result, the rate of asbestos-related mortality in this state has been somewhat lower than other areas of the nation. Since 1979, 460 Iowans (out of a population of approximately 2.9 million) have lost their lives to asbestos diseases. The overwhelming majority of these were from mesothelioma, which accounted for roughly 80% of these fatalities.

Where the Asbestos Is

For the most part, it was at the state's power plants where workers were exposed to asbestos. This is not surprising in light of a Puerto Rican study performed recently, where 13% of power plant workers showed some degree of asbestos-related scarring of the lungs when chest x-rays were examined.
Asbestos is primarily used as a fire retardant and heat shield. In facilities that have steam generators, asbestos packing is found in pipe fittings, while asbestos insulation is frequently used around pipes themselves as well as fire doors. While there have been efforts in the U.S. and abroad to reduce and abate asbestos products in such plants, malignant mesothelioma rates have been climbing in many areas.
The Iowa power plants are located primarily in and around the cities of Cedar Falls, Cedar Rapids, Council Bluffs, Davenport, Des Moines, Iowa City, Mason City, Sioux City and Waterloo, and include Alliant Power Stack, Duane Arnold Alliant Energy, Iowa Light & Power, Iowa Power and Light, Sioux City Coal and Gas, Storm Lake Power Plant and the Tipton Power Plant.
In addition, two chemical manufacturers - Irwin Chemical Company and USI - appear on the list of Iowa exposure sites. In addition to heat and fire resistance, certain types of asbestos - predominantly crocidolite - has been used in many applications where caustic, corrosive substances pose a hazard.
Crocidolite, or "blue" asbestos, is an amphibole, which is particularly deadly. Although asbestosis and forms of asbestos cancer such as mesothelioma can result from exposure to either amphibole or the softer chrysotile asbestos (sometimes touted by the powerful Canadian asbestos lobby as "safe" asbestos), the former tends to be faster-acting in causing the kind of cellular mutations that result in the development of cancer, according to medical research.

Agricultural Exposure to Asbestos

While asbestos is not usually a danger in farming and ranching industries, there are exceptions, particularly when it comes to buildings in which farm machinery is stored as well as the shops in which such machinery is serviced. Asbestos-containing material is found in gaskets and brake material, as well as the buildings themselves; this has been a problem in several small farming communities in eastern Colorado.
Another agricultural source of asbestos exposure is often from naturally-occurring deposits that are uncovered in the process of plowing and digging activities; however, this is more of a problem in the Southeast and California. Iowa, being primarily geologically inactive flatlands, has no natural asbestos deposits.

Community Statistics

Polk County, where the state capital and county seat of Des Moines is located, had the largest number of asbestos-related deaths in the 20-year period prior to the 2000 census, mainly due to one of three forms mesothelioma, the most common of which is pleural mesothelioma. In that same period, the general population of the Des Moines area increased by around 22%.
The lowest exposure rates were found in rural counties such as Sioux, Washington, Calhoun, Crawford, Grundy, Monroe and Winneshiek. In each of these counties, only a single victim was recorded during that time.
It should be noted that while these statistics account for deaths inside the state of Iowa, it does not take into account where the asbestos exposure took place or the specific occupations of the victims.

Iowa (IA) Mesothelioma Lawyer & Legal Resources:

People in Iowa with an interest in filing a Iowa mesothelioma lawsuit or hiring a Iowa mesothelioma lawyer should know that the statute of limitations for personal injury law in Iowa is two years with a discovery rule stating that this amount of time begins when the problem (in this case the mesothelioma) either was discovered or should have been discovered. Wrongful death cases fall under the same statute of limitations and follow the same discovery rule. However, Iowa's Supreme Court has adopted a "separate injury rule" that allows a plaintiff to file an Iowa mesothelioms lawsuit for asbestos cancer regardless of whether the victim had developed asbestosis at a much earlier date.
Under this rule, the discovery of asbestosis does not trigger the statute of limitations on asbestos-related diseases that develop later, including cancers such as mesothelioma, allowing victims of such cancers to hire an Iowa mesothelioma lawyer and pursue compensation for their disease. This means that mesothelioma victims in Iowa who have discovered the disease after having first developed asbestosis can file an Iowa mesothelioma lawsuit within the statute of limitations related to the discovery date of the cancer.
With 21 mesothelioma-related deaths in 1999, Iowa ranks 33 in the nation for mesothelioma cases. So while this issue is one of concern in the state, it is not pressing in comparison to a majority of states in the nation. Perhaps for this reason, there is not a significant number of high-profile mesothelioma or asbestos-related cases in the state. Oftentimes, when the issue arises, it results in mesothelioma settlement. For example, in 2004, Sioux City was awarded a $7,500 settlement from Wisconsin-based Old Republic Surety Company for rubble containing asbestos that resulted from the demolition of part of the Livestock Exchange Building. A clean-up plan was put in place and there are no known cases (as of yet) of asbestos-related disease caused by the construction-based asbestos exposure.
Although there has not been significant legislation on the issue, the state of Iowa does note concerns as in the above case. Another example of this is the early 2007 Iowa OSHA notice that worker safety is still compromised by exposure to asbestos, warning of asbestos's lingering presence in the automotive industry. More specifically, there is current concern in the state about asbestos-related disease in those employees who work on the brakes of older cars. The worker safety alert specifically addresses workplace safety and health issues and holds no jurisdiction over anyone working on older model vehicles during their leisure time, but health risks should be of concern to these amateur mechanics as well.
In another 2007 issue, students at one Iowa elementary school had their classes relocated as officials discovered that the glue on asbestos-containing ceiling tiles was failing, causing tiles to fall. Again, this points to the fact that despite lack of Iowa mesothelioma lawsuits, there are reasons for continued concern by Iowa's citizens. In fact, four mesothelioma victims and their Iowa mesothelioma lawyers have come together in 2007 in a lawsuit against a Des Moines company that manufactures putty used for wood and plaster repairs, model building and sculpting. This is only the second asbestos-related lawsuit for the company, which has made putty since 1932. In 2005 the first case was dismissed when tests conducted on behalf of the plaintiff failed to find asbestos.

California and Asbestos Lawsuits

n addition to implementing asbestos safety measures, California has long been one of the leading jurisdictions for asbestos lawsuit filings. Early asbestos lawsuits were generally filed in areas, including California, where significant numbers of workers had been exposed to asbestos. In the 1970s and 1980s, California was one of four states that accounted for more than 60 percent of state asbestos case filings. By 2000, the majority of asbestos filings occurred in a handful of other states, such as Texas.
Not all of these new case filings resulted in verdicts (e.g., they were dismissed or settled). However, from 1993 through 2001, California was among five states that accounted for 65 percent of asbestos trials that ended in verdicts.
Since 2000, some states with a significant amount of asbestos lawsuits began enacting laws to limit new filings. California has not enacted similar laws. Meanwhile, some of the state's courts have reportedly experienced increases in the number of asbestos case filings by both in-state and out-of-state claimants each year.
Although California has not enacted some of the reform laws that have been popular in other states, its courts have taken other measures to manage large asbestos caseloads and expedite claims by extremely ill patients. For instance, a "fast-track" scheduling approach allows cases of terminally ill patients to go to trial in 120 days. In addition, at least some judges actively encourage the parties to resolve cases quickly through trial or settlement.

California and Asbestos Regulations

As the national awareness about asbestos and its hazards grew and lawmakers enacted tougher regulations of the mineral, California concentrated its efforts on limited exposure. For instance, one asbestos-related regulation, Title 8, mandated employers take specific steps to ensure proper air quality and that they document all levels of potential exposure.
California school districts and institutions of higher learning also adopted new codes. State colleges and universities, acting independently, pushed through their own standards of abatement and exposure under state law. The University of California Santa Cruz in 2001 agreed to keep asbestos related records - exposure records, respiratory fit testing records, abatement records - for 30 years. It also set forth training for abatement and set certification standards.

Asbestos Laws in California

California is the site of several shipyards, marine repair facilities, power plants, mining operations and oil refineries where workers may have been exposed to asbestos. California is also home to some of the nation's largest asbestos deposits. Asbestos exposure can cause severe health problems, including mesothelioma cancer, a disease for which there is no cure.
Over the past decade, California lawmakers responded to these occupational and environmental asbestos risks with a number of laws, regulations, safety standards and programs aimed at reducing exposure. Included in the regulations were new certification requirements for contractors and consultants who handle and remove asbestos in the state.
California was not alone in proposing and adding asbestos regulations in recent years, although some states like Texas, Ohio and Georgia, added a layer of laws to combat a climbing number of asbestos related claims. What are the treatment options for mesothelioma?

The treatment for mesothelioma depends on whether or not it has spread. Unfortunately, when mesothelioma is diagnosed, it has usually already spread beyond the point where it could be removed.

Surgery

An operation may be an option if your mesothelioma is only in one area of your pleura. This operation may involve removing part, or all, of your pleura and part of your lung that is close to it. This type of operation is called a pleurectomy.

It is not yet known if having an operation improves symptoms more or can even help people to live for longer compared with not having an operation. There is a large study currently underway to look at this.

It is much less likely for you to have an operation if you have peritoneal mesothelioma, as this surgery is less likely to cure this type of mesothelioma.

Note: in some cases, treatment aims to cure the cancer. Doctors tend to use the word 'remission' rather than the word 'cured'. Remission means there is no evidence of cancer following treatment. If you are 'in remission', you may be cured. However, in some cases a cancer returns months or years later. This is why doctors are sometimes reluctant to use the word cured.

Radiotherapy

Radiotherapy is a treatment which uses high-energy beams of radiation which are focused on cancerous tissue. This kills cancer cells, or stops cancer cells from multiplying.

Radiotherapy is often used to improve symptoms such as pain or shortness of breath and also to reduce the size of any nodules that may have formed. Radiotherapy may also be given to your chest wall at the place where you have had a biopsy or a drainage tube has been inserted. This can be effective at preventing any mesothelioma from growing out through your chest wall.

Chemotherapy

Chemotherapy is a treatment of cancer by using anti-cancer medicines which kill cancer cells, or stop them from multiplying.

Chemotherapy is sometimes given and can slow the growth of mesothelioma and also improve symptoms you may have.

Other treatments

If you have recurrent effusions, where the fluid keeps building up between the linings of your lungs, then it is possible to have a procedure to reduce the risk of this happening in the future. This is called a pleurodesis. During a pleurodesis, a chest drain to drain the fluid is placed into the space between the linings of your lungs. A chemical is then injected into this space, which prevents the fluid from forming again. A local anaesthetic is used to numb the skin so it is painless.

What is asbestos?

Asbestos is a material that was used in buildings in the past. It is an insulating material that is both heat and fire resistant. There are different types of asbestos: white, brown and blue. Although they are all harmful, blue and brown asbestos are the most strongly linked with mesotheliomas and they have not been imported into the UK since 1985. However, they are still present in some buildings and equipment produced before the ban. White asbestos has been banned in the UK since 1999.

Asbestos materials which are left undisturbed are probably safe. It is asbestos dust or fibres which cause the harm when they are inhaled (breathed in) or ingested (swallowed).

Note: the majority of people who have been exposed to asbestos in the past are not likely to develop mesothelioma. However, it is not possible to identify which people exposed to asbestos are likely to develop mesothelioma in the future. As a general rule, the greater and more prolonged the exposure, the greater the risk.

What causes mesothelioma?

A cancerous tumour starts from one abnormal cell. It is thought that something damages or alters certain genes in the cell. This makes the cell abnormal and multiply 'out of control'. Certain risk factors increase the chance of certain cancers forming. (See separate leaflet What causes cancer? for more details.)

The most important risk factor for getting mesothelioma is being exposed to asbestos in the past. Around nine out of ten people with a mesothelioma have been exposed to asbestos in the past. A mesothelioma may occur 15-20 years after you have been exposed to asbestos.

Compensation is possible if your mesothelioma is due to asbestos exposure. This can be done either through benefits paid by the government or, if you believe your mesothelioma is due to asbestos exposure within a work environment, by suing the employer in question for the period

Mesothelioma UK is a resource centre dedicated to Mesothelioma. The centre co-ordinates communication and information about everything relevant to mesothelioma throughout the UK. We support any initiative that seeks to improve the life and experiences of mesothelioma patients and their carers.
Our team includes a Consultant Nurse, a Helpline Assistant, a Fundraising & marketing Manager and an Operational Manager. In 2010, we successfully handled over 1,100 helpline and e-mail requestsand circulated 1,760 newsletters 6 times during the year. Each year, we organise the National Mesothelioma UK Patients and Carers Day, and numerous educational events or healthcare professionals. In 2012 we are currently able to fund a further two Mesothelioma Specialist Nurses in remote or high incidence areas in the UK and hope to fund a further four so that anyone affected by mesothelioma has access to specialist knowledge and care.
We provide information and support for people affected by Mesothelioma. We have a national free phone helpline (0800 169 2409) that provides access to impartial, accurate and relevant advice specific to mesothelioma for patients, carers and health care professionals.  Callers to the helpline can access specialist nurse clinical advice, booklets and factsheets and can also be put in touch with local sources of information and support including, for patients and carers, contact with their local nurse specialist and local or nearest support group (where available).  For health care professional's we organise numerous training and educational events, regular news bulletins, have established a National Mesothelioma Nurse Action Team and generally support health care teams in the management of Mesothelioma patients.  We collaborate with all other interested parties to raise awareness about Mesothelioma and the dangers of asbestos and coordinate events surrounding Action Mesothelioma Day in July each year.
Initially funded by Macmillan Cancer Support, Mesothelioma UK now relies totally on voluntary donations to our own independent charity; Mesothelioma UK Charitable Trust.

Peritoneal Mesothelioma

The peritoneum also has two layers the inner (visceral) layer which is next to the abdominal organs and the outer (parietal) layer which lines the abdominal wall.
Peritoneal mesothelioma causes the peritoneum to thicken and fluid to collect in the abdomen. This collection of fluid is called ascites and causes the abdomen to swell. Because pleural mesothelioma is more common and often spreads to the peritoneal cavity, it is sometimes necessary to determine if pleural mesothelioma is the primary cancer.

Mesothelioma Diagnosis

The diagnosis of mesothelioma is usually made by a pathological review of tissue taken from the tumor. Pathologists use a series of immunohistochemical stains to distinguish between mesothelioma and other types of cancer.

Types of Mesothelioma:

Pleural mesothelioma is the most common form, followed by peritoneal mesothelioma. Pericardial mesothelioma is exceptionally rare.

Histological Types of Mesothelioma:

There are three main histological types of mesothelioma:

Filing a Mesothelioma Lawsuit

o start the process of seeking compensation for a mesothelioma client, ELSS begins with a brief introductory meeting. During this meeting, an attorney from ELSS will outline the various steps of the legal process; address any questions or concerns you may have related to the legal process; and discuss the ways in which a mesothelioma client has been exposed to asbestos.
After this introductory meeting, ELSS will work on your behalf to collect all diagnosing medical reports from the medical facilities where you were treated. Before a mesothelioma lawsuit is filed, ELSS performs a thorough work history investigation of the diagnosed party. ELSS will collect work history records, including, union records, military service records and other documents to substantiate employment history. In addition to interviewing the mesothelioma client, ELSS will also identify any potential family members, co-workers, and other product identification witnesses who can assist in providing details about the work history and potential asbestos exposure in the case.
After we have completed a thorough product identification and work history investigation, our next step is to identify potential recoveries through asbestos trusts. A number of companies have admitted past asbestos liability and have set up asbestos trusts to compensate mesothelioma clients who present qualifying claims. After filing of the Complaint, the Discovery phase commences and usually lasts 3 to 4 months . Discovery allows ELSS to present information to the Defendant asbestos companies which document where, when and how the mesothelioma client was exposed to particular asbestos products. ELSS can present this information via written documents (interrogatories) and/or oral testimony (deposition) to the Defendant asbestos companies. The Defendant asbestos companies will also be entitled to present information and/or document to your attorney during this period. ELSS will also file appropriate motions in Court during the Discovery phase on the mesothelioma clients behalf. Additionally, ELSS will likely try to reach some financial settlement(s) during the Discovery phase.
Most mesothelioma lawsuits will not end up going to trial, but rather will resolve in settlements well in advance of the trial date. Throughout the entire process, ELSS will discuss the strengths and weaknesses of seeking trial resolution vs. settlement with the mesothelioma client.
